Terms of Use

This translation is provided for convenience. If there is any discrepancy, the Portuguese version prevails.
These terms govern the use of Fotosfy (the fotosfy.com website, the app at app.fotosfy.com, the Android apps and the Telegram bot), run by Neto Ribeiro, a private individual resident in Brazil. By creating an account, you agree to these terms and to the Privacy Policy.
1. The service
Fotosfy stores, organises and shows photos — in albums, on the TV and through shared links — and receives photos from the app, from Telegram and from party guests. New features may be added and others may change.
2. Your account
- You must be 18 or over.
- The information you give when signing up must be true.
- You are responsible for keeping your password secret and for everything that happens in your account.
- The account is personal. Whatever you connect (Telegram, TVs, party guests) uses the service within your account and under your responsibility.
3. Your content
- Your photos and text remain yours. You give us only the permission needed to run the service: to store them, create smaller versions, show them where you tell us to (including to anyone with the link to a shared album) and make backups.
- You confirm that you have the right to send each photo and, where necessary, the consent of the people shown — especially of the parents or guardians of children and teenagers.
- Fotosfy is not a substitute for a backup: keep your original files too.
4. Sharing and parties
- Anyone with the link to a shared album can see its photos. You can add a password and switch the link off at any time.
- At a party, whoever creates the party is responsible for the guests they invite and decides which photos appear on the TV. Guests must also follow these terms.
5. What is not allowed
- Sending illegal content, including any child sexual abuse material — which will be removed and reported to the authorities.
- Sending nudity or intimate content of someone without their consent.
- Content that promotes hatred, violence or harassment.
- Infringing third parties’ copyright or image rights.
- Trying to get around limits, break into accounts, exploit flaws or overload the service.
- Reselling or redistributing the service without permission.
We may remove content and suspend accounts that break these rules.
6. Plans and payment
- There is a free plan and paid plans, monthly or annual, with the storage, photo and device limits shown on fotosfy.com.
- Prices are in US dollars (US$) and payment is handled by Stripe. Your bank may charge fees and apply an exchange rate.
- The subscription renews automatically at the end of each period until you cancel it.
- Price changes are announced at least 30 days in advance and apply from the following renewal.
7. Cancellation and refunds
- You can cancel at any time in the app (Billing → manage subscription). The plan continues until the end of the period already paid for, and then the account returns to the free plan. There are no pro-rata refunds for periods in progress.
- Right to cancel: when you first take out a paid plan, you can change your mind within 7 days and get a full refund (Brazil’s Consumer Protection Code, art. 49). If you live in the European Union or the United Kingdom, this period is 14 days.

8. Plan limits
If your account goes over the plan’s limit (for example, after returning to the free plan), nothing is deleted: only new uploads are blocked until you free up space or change plan.
9. Availability
We work to keep Fotosfy online, but it may be unavailable because of maintenance, supplier failures or reasons beyond our control.
10. Liability
To the extent permitted by law, we are not liable for indirect losses or for the loss of content you had no copy of. Nothing in these terms limits rights that Brazil’s Consumer Protection Code, or the consumer protection law of your country, does not allow to be limited.
11. Closing an account
- You can delete your account at any time — see Delete account.
- We may close accounts that break these terms, giving notice beforehand whenever possible.
- The data of a closed account is deleted as described in the Privacy Policy.
12. Changes to these terms
Significant changes are announced at least 30 days in advance by your account’s email or within the app. Continuing to use the service after that means you accept the new terms.
13. Governing law and jurisdiction
These terms are governed by Brazilian law. The courts of the consumer’s place of residence have jurisdiction. If you live in the European Union or the United Kingdom, you keep the mandatory protections of your country’s law.
